These Terms of Use (“Terms”) govern your use of drmycare.com (the “Site”), operated by MedCare Link LLC (“MedCare Link,” “we,” “us” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

The Site provides general information about the MyCare platform. You may use the Site only for lawful purposes. You agree not to interfere with the Site’s operation, attempt to gain unauthorized access to it, or use it to transmit harmful code or unlawful content.

2. No medical advice

Content on the Site is for informational purposes only and is not medical advice. Using the Site does not create a provider–patient relationship. MyCare supports, and does not replace, the professional judgment of licensed healthcare providers.

3. Performance figures

Statistics shown on the Site — including patient-capacity, time-savings, cost-reduction and return-rate figures, and results from the ROI calculator — are based on MedCare Link internal estimates and projections. They are illustrative only and are not a guarantee of results. Actual results vary by practice.

4. Intellectual property

The Site and its content, including the MyCare name and logo, text, graphics and software, are owned by MedCare Link or its licensors and are protected by intellectual property laws. You may view the Site for your personal or internal business use only. Apple, Apple Health, Apple Watch and iPad are trademarks of Apple Inc.; Android is a trademark of Google LLC. Third-party marks are used for identification only and do not imply endorsement.

5. Information you submit

Information you submit through the Site is handled as described in our Privacy Policy. Please do not submit patient health information through the Site.

6. Third-party links and services

The Site may link to or rely on third-party websites and services. We are not responsible for their content, policies or practices.

7. Disclaimer of warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MEDCARE LINK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

9. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.

10. Changes to these Terms

We may update these Terms from time to time by posting the revised version on this page and updating the effective date above. Your continued use of the Site after changes are posted means you accept the revised Terms.

11. Notice to California users

Under California Civil Code § 1789.3, California users are entitled to the following consumer rights notice: the Site is provided by MedCare Link LLC, 18008 Skypark Cir, Irvine, CA 92614.
